Trendy Photographic LLC Terms of Service, Client Guidelines & Privacy Policy

01. Copyright, Authorship & Intellectual Property Ownership

Original photographs, video footage, edited videos, drone imagery, graphics, and other copyrightable creative works produced or delivered through Trendy Photographic LLC ("Trendy Photographic," "we," "us," or "our") are protected by applicable intellectual property laws.

Copyright belongs to the lawful copyright owner. Trendy Photographic owns rights in works validly created as works made for hire for the Company or transferred to it through a legally effective agreement. Where a photographer, videographer, contractor, or other creator owns the copyright, Trendy Photographic may grant only those rights it has been authorized to license.

Unless the lawful copyright owner expressly agrees to transfer copyright through an appropriate signed written instrument, payment, commissioning, access to a gallery, delivery of files, and use of the media do not transfer copyright ownership to the Client.

The Client receives only the usage permissions provided in these Terms and the accepted written proposal, estimate, order, invoice, or separate licensing agreement. Exclusive rights, copyright assignments, and other transfers of copyright ownership require a separate agreement signed by the lawful copyright owner or authorized representative.

Raw files, unedited captures, working project files, editing catalogs, and intermediate versions are not included unless expressly stated in the accepted scope of work. Intellectual property owned by third parties remains the property of its respective owners.

02. Commercial Photography, Production Fees & Usage Licensing

Commercial photography and media projects include work commissioned by restaurants, bars, hotels, hospitality businesses, retail brands, corporations, publishers, agencies, venues, and other businesses, including promotional, product, editorial, and advertising assignments.

Production and licensing are distinct A commercial quotation may identify separate charges for photography or video production, editing and retouching, usage licensing, travel, and other services, or may combine these charges in one project price. The license fee depends on the intended uses, number of licensed images, media channels, audience, geographic territory, duration, exclusivity, and other requested rights. No universal per-image commercial license fee applies unless a quotation specifies one.

Scope of a commercial license The applicable written proposal, order confirmation, or separate license controls which images are licensed, who may use them, the permitted purposes, channels, territory, duration, exclusivity, and fee. A non-exclusive license allows the copyright owner to continue using or licensing the works to others unless otherwise agreed. A commercial license does not by itself convey copyright ownership.

Examples of usage that may be authorized in an individual project include a company website, organic social media posts, email newsletters, brochures, press materials, physical signage, paid online advertising, print advertising, out-of-home media, and broadcast campaigns. Only the uses actually agreed to for that project are included. No broad or perpetual commercial license is automatically granted merely because the Client purchases high-resolution files.

Uses requiring express approval unless already included

• Paid advertising, boosted social posts, broadcast media, and large-scale advertising campaigns.
• Printing images on merchandise intended for sale, including shirts, accessories, posters, packaging, or other products.
• Independent use by affiliates, business partners, franchisees, advertisers, property owners, venues, or other third

parties.

• Resale, stock distribution, independent sublicensing, exclusive use, or any copyright assignment.

A Client may share delivered files with designers, printers, public relations firms, or marketing agencies working on that Client's behalf solely to carry out uses already permitted under the Client's license. This does not authorize those vendors to use the images independently.

Timing, additional uses, and third-party rights Unless the accepted project agreement provides otherwise, the agreed commercial license becomes effective when all applicable production and licensing fees have been paid. Additional uses may be requested and licensed in writing for an additional fee. Any ambiguity about intended commercial use should be resolved in writing before publication or distribution.

The Client is responsible for obtaining permissions necessary for its intended use from the venue, property owner, subjects, or holders of any artwork, trademarks, or other third-party rights, as applicable. Trendy Photographic cannot license rights it does not own or control.

03. Real Estate Photography & Property Marketing License

For real estate listing photography and related property media, upon satisfaction of the applicable payment terms, the ordering Client receives a non-exclusive, non-transferable license to market the specific photographed property and promote the ordering Client's own real estate services.

Permitted uses include MLS listings, the applicable brokerage's listing page, property websites, social media, print and digital listing marketing, client presentations, email campaigns, and a historical portfolio of the ordering Client's completed work.

MLS systems, syndication partners, brokers, and service providers may receive or display the files as reasonably necessary for the authorized marketing of that property and subject to applicable platform requirements. This does not give unrelated parties an independent right to reuse the media for their own advertising.

The images may not be sold, sublicensed, reassigned, or used independently by another agent, brokerage, owner, builder, architect, contractor, designer, stager, vendor, short-term-rental operator, publication, or other commercial party without permission from the appropriate licensor. A new listing agent or other party must obtain its own license before reusing the photographs.

After the listing ends, the ordering Client may continue showing previously licensed media in a genuine past-work portfolio, provided it is not used to actively market the property for an unauthorized party or in a manner otherwise prohibited by a separate agreement.

04. Headshots, Portraits, Teams & Personal Branding License

For headshots, portraits, team portraits, and personal-branding sessions, the photographed or ordering Client receives a non-exclusive license, after payment, to use delivered images for the agreed individual, team, or company's professional and self-promotional purposes.

Permitted uses ordinarily include the Client's website, social media, biographies, resumes, business cards, staff directories, press materials, professional presentations, and self-promotional marketing, unless a project agreement limits the scope.

Images may not be resold, uploaded to stock platforms, relicensed to unrelated businesses, represented as another creator's work, or transferred for independent third-party marketing without written authorization. Separate advertising or product-endorsement uses involving recognizable people may require additional permissions.

05. Portfolio, Promotional Display, Privacy & Releases

Properties, venues, and completed projects Subject to any accepted confidentiality requirement, Client privacy request, access restriction, and applicable third-party rights, Trendy Photographic may display work from a completed project in its portfolio, website, social media, advertising, sample galleries, award submissions, and educational or sales presentations. We will make reasonable efforts to honor a Client's written request for a private or confidential project received before we publish it.

A license to photograph a space or the copyright in an image does not necessarily confer the right to advertise using the name, logo, protected artwork, privately controlled location, or identifiable individuals depicted in the image. Separate permissions may be necessary.

Identifiable individuals and model releases Trendy Photographic will use headshots, portraits, team photography, interviews, personal-branding images, or other media featuring identifiable individuals in its own advertising or promotional materials only where it has obtained appropriate written or electronic consent from the person depicted or a legally authorized representative, where required. Consent may be documented through a model release, contract, written email approval, or an optional consent checkbox.

Parents or legal guardians must provide authorization when legally required for identifiable minors. Where project participants, event attendees, or guests are involved, the Client must communicate any restrictions and obtain any Client-side permissions it is responsible for securing.

06. Scheduling, Booking & Scope of Work

Appointments may be requested through our booking system, email, phone, or another mutually agreed process. A booking is confirmed when accepted by Trendy Photographic and subject to any stated deposit or payment requirements.

The Client must provide accurate contact information, address, square footage (when applicable), requested services, access arrangements, special instructions, venue contacts, availability restrictions, and other material details necessary to

plan the assignment.

Quoted pricing and scheduled duration rely on the described scope. Material differences in square footage, locations, number of spaces, requested images, required staging or retouching, after-hours access, or other conditions may result in additional time or fees, which we will communicate when reasonably possible.

Arrival times may be affected by traffic, parking, weather, building access, or earlier assignments. We will make reasonable efforts to communicate significant delays.

07. Rescheduling, Cancellations & No-Shows

• More than 24 hours before the scheduled appointment: no cancellation or rescheduling fee.
• Less than 24 hours before the scheduled appointment, but before arrival or the appointment begins: a fee of up to

10% of the scheduled order may apply.

• After the photographer arrives, the appointment begins, or work starts: a fee of up to 50% of the scheduled order may

apply. The above cancellation fee tiers are alternatives, not cumulative charges for the same cancellation event. For unusually large commercial productions, any different cancellation or non-refundable reservation terms must be presented and accepted in the project-specific agreement.

Weather-related rescheduling may be accommodated without penalty when conditions make requested services unsafe or impractical. Trendy Photographic may waive or modify a cancellation fee in exceptional circumstances at its discretion.

08. Communication & Customer Support

Regular support hours are Monday through Friday, 9:00 AM to 5:00 PM Eastern Time, and Saturday, 9:00 AM to 1:00 PM Eastern Time. Requests received outside these hours may be addressed the next business day. We will try to accommodate urgent schedule changes when practicable.

09. Property or Venue Access, Missed Access & Return Visits

The Client must arrange lawful, safe, and timely access to the site and provide keys, lockbox codes, alarm information, gate or building access, concierge approvals, on-site contacts, parking guidance, and any needed permission from owners or operators.

If we cannot access the location or begin the agreed assignment because access has not been arranged, an $80 missed-access or return-visit fee may apply. Additional travel or service fees may apply for return visits caused by inaccessible or unprepared spaces or areas omitted from the original visit.

A venue that must be photographed without guests, staff, or patrons must be made available in the agreed condition during the scheduled time. The Client remains responsible for coordinating with the venue to meet these requirements.

10. Property & Venue Preparation

The Client should ensure that a property or venue is ready to photograph at the scheduled time. For residential property, this may include turning on lights, arranging window coverings, clearing counters and clutter, preparing rooms and outside areas, moving vehicles, and securing pets.

For commercial spaces, the Client should arrange needed access, general cleanliness, lighting, displays, signage, product placement, and on-site approvals. Unless specifically booked, our photographers are not cleaners, movers, professional stagers, or venue staff.

Minor adjustments may be made when practical and safe. Time spent waiting for access, staff clearance, or site preparation may reduce available shooting time or require a revised scope.

11. Turnaround Times & Delivery Estimates

Unless the booking or accepted proposal states otherwise, our usual estimated turnaround is:

• HDR photography and virtual twilight photographs: next-day delivery.
• 2D floor plans: generally within 24 hours.
• Zillow 3D Home and Matterport: generally within 24-36 hours, subject to third-party processing.
• Edited listing videos and reels: approximately 1-2 business days.
• Custom or more complex video projects: approximately 2-3 business days.
• Virtual staging, advanced retouching, and custom commercial work: timing confirmed according to scope.

Same-day or rush service may be offered for an additional fee, subject to availability. Delivery estimates are not guaranteed deadlines unless expressly stated in an accepted agreement; large projects, revisions, holidays, technical problems, third-party processing, or events outside our control can affect delivery.

12. Photography, Editing & Retouching

Standard HDR photography typically includes exposure blending, professional color and exposure correction, perspective adjustments, window-view balancing, and minor cleanup when appropriate.

Our editing aims to present the subject professionally while retaining a reasonable, accurate representation. Extensive object removal, heavy retouching, composite construction, virtual staging, significant landscaping changes, major structural alterations, and other advanced edits are not included unless specified in the selected service or written proposal.

The Client must disclose any editing restrictions relevant to the intended use, including documentary/editorial requirements, venue authenticity, real estate advertising rules, or brand standards.

13. Floor Plans, Measurements & Approximate Square Footage

Floor plans, measurements, and square-footage estimates are supplied for marketing and informational purposes only. They are approximate and may differ from surveys, tax records, appraisal reports, blueprints, architectural or construction measurements, and other official sources.

Clients and recipients must independently verify dimensions when accuracy matters. Floor plans and measurements are not professional architectural, engineering, construction, appraisal, survey, tax, or legal documents and should not be relied upon for those purposes.

14. Zillow 3D Home, Matterport & Virtual Tours

Virtual tours may be created or hosted through platforms such as Zillow 3D Home, Matterport, and other service providers. Processing, hosting, available features, continued public access, and platform terms are controlled in part by the relevant third party.

Trendy Photographic is not responsible for third-party policy changes, outages, discontinued features, technical failures, hosting limitations, or processing delays outside our reasonable control.

15. Drone & Aerial Services

Aerial photography and video are subject to weather, wind, visibility, site conditions, airspace limitations, FAA requirements, flight authorization availability, safety, and any other legal or operational restrictions.

We will not conduct a flight that would be unsafe or unlawful. If requested aerial services cannot be performed, we may arrange a suitable reshoot, an agreed substitute, or an appropriate credit or refund for the unavailable aerial portion. The safety and legal requirements of each flight take priority over delivery preferences.

16. Video Editing, Music & Revisions

Unless the selected service specifies otherwise, listing videos and social reels include one reasonable round of revisions within the originally agreed creative scope. Clients should consolidate requested changes and identify them clearly.

Major revisions to music, voice-over, shot selection, structure, script, graphics, style, duration, or creative direction, including requests after final approval, may incur additional fees.

Music, sound effects, typefaces, graphics, stock elements, and other third-party assets may have independent licensing restrictions. Any commercial advertising or broadcast use must comply with the relevant asset licenses; possession of an edited video does not automatically expand a third-party music license.

17. Virtual Staging, Twilight & Digital Modifications

Virtual staging, sky replacement, digital twilight, object removal, AI-assisted modifications, and other digital alterations are marketing tools and may be subject to platform, brokerage, MLS, consumer-protection, and disclosure requirements.

The Client is responsible for complying with the rules and laws governing the Client's publication or advertising. We should not be instructed to conceal material defects or to misrepresent a property's fixed features, condition, layout, or characteristics in a misleading way.

18. Payment, Invoices & Additional Charges

Payment is due in accordance with the booking, accepted estimate, order confirmation, or invoice. Unless an approved billing arrangement applies, Trendy Photographic may withhold final delivery or gallery downloads until payment is received.

Added services, advanced editing, rush work, return visits, extra travel, commercial usage expansion, or revisions outside the accepted scope may be invoiced separately after the Client authorizes the additional work.

Payment for the work does not grant broader usage rights than the applicable license permits. Any deposit, installment, or final-balance requirements for custom commercial projects will be stated in the applicable quotation.

19. Travel Fees & Service Territory

Our primary service area is Washington, D.C., Maryland, and Northern Virginia. Travel charges may apply outside the standard coverage area or where assignments involve unusual travel time, parking, tolls, or access needs.

We will endeavor to disclose applicable travel charges through the booking process or in the project estimate before the appointment.

20. File Formats, Galleries, Delivery & Storage

Final media may be delivered by Trendy Photographic's client portal, Aryeo, or a designated cloud-delivery service. File formats, orientation, resolution, image quantities, and file specifications are determined by the service or accepted project scope.

Clients should download and preserve their own backups promptly. We do not guarantee indefinite retention of delivered files, perpetual access to cloud galleries, or continued availability of third-party download links. We may archive, migrate, or remove older projects as platforms, capacity, or business processes change.

21. Third-Party Services & Software

We use or may use external vendors for scheduling, payments, video hosting, 3D tours, file storage, website services, communications, and delivery. These providers may experience outages, remove features, change pricing or policies, or interrupt access outside our control.

Where feasible, we will make reasonable efforts to arrange an alternative delivery or service method when a third-party issue materially affects an order.

22. Client Authority, Location Permissions & Compliance

The Client represents that it has appropriate authority to book the assignment, authorize entry to the location, give instructions, and use any materials it provides. The Client is responsible for permissions required by an owner, tenant, venue operator, employer, or other rights holder where applicable.

The Client is responsible for compliance with applicable MLS rules, brokerage standards, housing advertising requirements, privacy rules, commercial advertising standards, consumer-protection laws, disclosures concerning digital alterations, and restrictions affecting the Client's particular use of delivered media.

A Client commissioning imagery that depicts a third-party venue, brand, artwork, or identifiable person should confirm necessary consents for the intended commercial distribution, especially advertising, product sales, or endorsement.

23. Safety, Site Conditions & Right to Stop Work

Trendy Photographic may postpone, modify, end, or decline services when conditions present a reasonable risk to persons, property, equipment, or legal compliance. Examples include unsafe structures, hazardous substances, threatening animals or people, unsafe aerial conditions, severe weather, unlawful instructions, inaccessible areas, or other significant hazards.

We will attempt to communicate the concern and discuss appropriate scheduling or scope adjustments when it is practical to do so.

24. Service Quality, Corrections & Refund Requests

Because photographic and media production services are customized, fees for completed services are generally non-refundable, subject to applicable law and the specific agreement.

If delivered media contains a material technical defect or an apparent failure to deliver the agreed scope, the Client should contact us promptly with a description and examples. When a problem attributable to our work is verified, Trendy Photographic may offer appropriate corrections, re-edits, reshooting, a service credit, or a partial or full refund as warranted by the circumstances.

25. Force Majeure & Events Beyond Reasonable Control

We are not responsible for delays or inability to perform caused by circumstances beyond our reasonable control, such as severe weather, emergencies, illness, natural disasters, government orders, travel disruptions, infrastructure failures, internet outages, or significant third-party service interruptions.

When reasonably possible, we will communicate the situation and seek a practical rescheduling, substitution, or other appropriate solution.

26. Limitation of Liability

To the maximum extent permitted by applicable law, Trendy Photographic's aggregate liability arising from a particular order or service will not exceed the amount the Client paid for the service giving rise to the claim.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or speculative losses, including lost sales, missed listing opportunities, lost profits, third-party platform failures, or MLS-related issues.

Nothing in these Terms excludes or restricts liability or remedies that cannot lawfully be excluded or limited.

27. Privacy: Information We Collect & How We Use It

To provide services, we may collect contact details, names, email addresses, phone numbers, business and property addresses, booking information, entry instructions, project communications, invoices, payment status, service history, and other information reasonably needed to fulfill an order.

We use this information to arrange and perform services; communicate with Clients; deliver media; administer accounts, billing, customer support, and lawful recordkeeping; protect the security of our services; and improve our business operations. We do not sell Client personal information to advertisers or unrelated third parties.

Payment credentials are generally processed by the applicable payment processor rather than stored directly by Trendy Photographic. We may share necessary information with service providers who support booking, client portals, file delivery, payments, hosting, email, analytics, storage, and accounting, subject to their respective practices and our arrangements.

28. Privacy: Cookies, Retention & Requests

Our website may use cookies and analytics technologies to operate site features, understand site traffic, and evaluate marketing. Browser and platform settings may provide controls over certain cookies.

We retain information for legitimate operating, security, tax, accounting, legal, dispute-resolution, and customer-service purposes for as long as reasonably needed or required by law. Client information may be subject to applicable service-provider terms and legal obligations.

For questions about personal information or to submit a privacy-related request, contact jimmytrendy@outlook.com. We will review requests in accordance with applicable law. Do not send passwords, sensitive identity documents, or payment-card numbers by ordinary email.

29. Governing Law & Dispute Venue

These Terms are governed by the laws of the District of Columbia, without regard to conflict-of-laws principles, except where another law must apply.

Unless otherwise required by applicable law or agreed through a separate lawful dispute-resolution agreement, disputes arising from these Terms or services will be brought before a court with proper jurisdiction in the District of Columbia.

30. Order of Documents & Written Project Exceptions

An accepted, project-specific written estimate, proposal, statement of work, license, or services agreement controls over these general Terms to the extent it expressly addresses the same issue differently. Remaining provisions of these Terms continue to apply where consistent and permitted by law.

No project-specific promise of exclusive rights or copyright transfer is effective without the legally required signed writing from the appropriate copyright owner. We may agree in writing to additional services, revisions, licenses, or special project conditions.

31. Updates to These Terms

We may revise these Terms to reflect changes in services, operational processes, applicable laws, technology, or third-party products. Unless a different rule is required by law or expressly agreed, the version supplied or made available at the time a booking is accepted will govern that order. A later website revision does not automatically rewrite a previously accepted agreement.

32. Acceptance of Terms

Clients should review these Terms before placing an order. By checking an acceptance box, signing a proposal, or otherwise affirmatively accepting these Terms in connection with a booking, the Client agrees to the applicable version. Acceptance may also be evidenced by other legally effective communications or conduct under applicable law.

Where practical, Trendy Photographic will present a conspicuous link to these Terms during online checkout or quotation approval and keep a record of the agreed project scope and licensing terms.
